This bill requires any institution of higher education that receives public funding and that requires any student or prospective student to receive an immunization as a condition of attendance to waive the immunization requirement for a student or prospective student if the student or prospective student objects to the immunization for reasons of health, religion, or personal conviction. Under the bill, no institution of higher education may require that a student or prospective student provide any explanation or justification of the student's or prospective student's objection to an immunization. Further, the bill requires an institution of higher education that receives public funding to inform a student or prospective student of the student's or prospective student's right to a waiver from the institution of higher education's immunization requirements in writing at any time the institution of higher education informs the student or prospective student of the immunization requirements.

Madison, WI (March 9, 2023) – After weeks of proactive citizen lobbying efforts by members of Wisconsin United for Freedom (WUFF), and after the 9 hour long public hearing on Tuesday, March 7 th , 2023 in the Joint Committee for Review of Administrative Rules (JCRAR), JCRAR voted in favor of suspending certain DHS 144 rules.
In 2019 Wisconsin DHS proposed rule changes that went into effect Feb. 1, 2023, one of which added the meningococcal vaccine to Wisconsin's vaccine requirements for 7 th and 12 th graders.
Today, those rules were suspended.
“Wisconsinites from across the state attended this hearing to make their voices heard and to tell their elected officials that they do not want any more vaccination requirements added to our childhood schedule. How many is too many, and who gets to decide?” said Tara Czachor, Co-Founder of Wisconsin United for Freedom. “Wisconsin DHS should not be unilaterally making additional vaccine requirements for Wisconsin children without legislative oversight. We are very happy with this outcome, and that Wisconsin parents will continue to be in the driver’s seat as it relates to medical decisions for their children.”
Senator Nass released a statement specifying which rules were suspended.
The suspension:
1. Removes the meningitis vaccine (first and second doses) from the table of required immunizations. Removes references in the rule related to requiring the meningitis vaccine.
2. Removes Varicella (Chicken Pox) and Meningococcal disease from the list of diseases for which DHS can exercise their “substantial outbreak” powers.
3. Removes the new requirement that a physician, physician assistant, or advanced practice nurse prescriber must confirm a child’s history of chicken pox in order for the student to be exempt from having to receive the vaccine. *Previously the administrative code required only a parent to document that their child had previously had chicken pox for the exemption to apply. Wisconsin has 3 vaccine exemptions available for parents/guardians to use to exempt out of requirements in order to attend school and day care.

As of today, Wisconsin has three vaccine exemptions available for day care and K-12 children.
In the event that the legislative majority decides to remove vaccine exemptions, we need the protection RIGHT NOW of the Joint Committee for Review of Administrative Rules. We need them to suspend a rule requiring additional vaccines for Wisconsin school children. This is an action that is going to protect us in the future, should the worst happen.
It is VITAL. You may think that Wisconsin exemptions are secured today, but they are not. If the legislature decides to remove exemptions in the future, we need the Rules committee to have our back and suspend these requirements NOW.
The process that DHS used here to add the meningococcal vaccine onto the requirements for WI students is the same process they will use to add OTHER additional vaccine requirements to our schedule.

Wisconsin DHS proposed some rule changes a few years ago that just went into effect Feb. 1st, 2023, one of which added the meningococcal vaccine to Wisconsin's vaccine requirements for 7th and 12th graders.
We do not need any additional vaccines added to WI's required vaccination schedule, and we have the chance here to encourage the Joint Committee for Review of Administrative Rules to suspend these rule changes.
DHS has already alerted day care centers and schools of the updates, and we believe they are purposely being unclear to cause confusion and misunderstandings. Exemptions DO still stand – Wisconsin has personal, religious, and medical, however it is imperative we continue to push against any and all additions of vaccine requirements/mandates on our schedule for daycare/school. We have had enough of the heavy-handed government telling citizens what to do.

DHS advocated for requiring/mandating the meningococcal vaccine for 7th and 12th graders at the same time as the stakeholders they utilized to work on these rule changes with were also advocating for the removal of Wisconsin’s personal exemption to vaccination for day care students and K-12 students.[i] [ii] Doctors, nurses, and medical professionals typically:

2016- 6 cases of meningococcal disease reported, only 1 from the result of a strain covered by MenACWY vaccine.[xv]
2017- 4 cases of meningococcal disease reported, but only 1 case from a strain covered by MenACWY vaccine.[xvi]
2018- 10 cases of meningococcal disease reported, but only 4 cases reported from a strain covered by the MenACWY vaccine.[xvii]

6. Wisconsin DHS does not publicly report the vaccination status of individuals who developed meningococcal disease; therefore, we cannot account for vaccine failure. Vaccination status is available for mumps, varicella, and pertussis as part of Wisconsin’s Vaccine-Preventable Diseases Surveillance Summaries and WI DHS should be required to be transparent with their data.[xix]
7. DHS advocated for this mandate on Wisconsin children when 80% already voluntarily comply with their recommendations. DHS has proven that if it were up to them, many more, if not all, vaccines would be mandated.
8. It is necessary for our legislators to protect our choice from an agency that clearly does not.

Dear Senator/Representative-
I am writing to request that you schedule a public hearing regarding CR 19-079 in the Joint Committee for Review of Administrative Rules.
Though this rule change, which already went into effect Feb. 1, 2023, WI DHS is now mandating the meningococcal vaccine for Wisconsin children entering 7th grade. They are also adding a booster dose for students entering 12th grade. This is unacceptable especially given the last few years we have all had to deal with bureaucratic overreach by our public health agencies at both the state and the federal level. This vaccination remains available to any parent who wishes for their child to receive it. The issue for us here, is that because it’s already available, there is no necessity to add it to the required schedule. Not only is it available, but in 2019, the year the most recent data is reported by the CDC, only 1 case was reported in Wisconsin for the serogroup ACWY of which this vaccine targets.[i]
What cannot be understated, is the fact that it is very clear to us that Wisconsin DHS will continue to do everything in their power to mandate/require as many vaccinations for our children as they possibly can. They were advocating for mandates/requirements at the same time as they were advocating for the removal of one of our exemptions here in Wisconsin back in 2019: our personal exemption (SB262)[ii]. We do not need any more requirements here in Wisconsin. Parents, working hand in hand with their own trusted health care providers, can come to their own decisions on this issue – whatever those decisions are, without the Government heavy handedly imposing yet another mandate/requirement upon them. Parents can already choose to get their child vaccinated with the meningococcal vaccine, and over 80% since 2019 voluntarily chose to do so without a mandate.[iii]
Many parents also do not know that they can use an exemption, and many schools or health care providers do not easily provide that information willingly to parents. We must not allow DHS the ability to have another mandate/requirement notch on their belts. It will never stop.
Regarding rule 1, by changing the definition of ‘substantial outbreak,’ unvaccinated children will be punished and excluded from school, even though data collected from Wisconsin DHS has demonstrated that the vaccine fails to protect, and fully vaccinated individuals can still develop chickenpox. Further, several peer-reviewed studies have shown that the live virus chicken pox vaccine can cause vaccine strain chicken pox infection in others via shedding. This information is also noted in the vaccine package insert published by the vaccine manufacturer.
Regarding rule 2, the substantial outbreak definition change, by changing the definition of ‘substantial outbreak,’ unvaccinated children will be excused from school even though data collected from DHS clearly shows that unvaccinated individuals are not developing mumps. Vaccine failure related to an ineffective vaccine is responsible for all reported mumps cases in Wisconsin in recent years. This is not unique to Wisconsin. Numerous studies examining mumps outbreaks that have occurred in highly vaccinated populations have experts admitting that both the waning of vaccine-acquired immunity and an ineffective mumps vaccine are to blame. We must not allow Wisconsin DHS to exclude healthy children from school.
Another point to make is that that DHS states in their proposal that it would be easier for students to get vaccinated for Tdap and the meningococcal vaccine at the same time. Where is the science that shows co-administering this vaccination with others is safe? We know that the CDC also recommends influenza vaccinations, as well as COVID-19 vaccinations for each age group. Where is the science that shows administering the MenACWY vaccine with other vaccines, such as Tdap (3 separate vaccinations), influenza, or COVID-19, is safe for our Wisconsin children?
At the Response to the State of State address back in 2020, Speaker Vos stated, “We won’t allow anyone to mandate vaccinations on our citizens.” I implore those of you on the JCRAR committee to help stand by those words now 3 years later. You have an opportunity to stand for freedom right now, and we ask that you please do so.
As a Wisconsinite, I am calling on you to uphold our rights as citizens and step in to protect our freedom to make individualized medical decisions for ourselves and our families. Do the right thing and ensure that DHS knows that the people of Wisconsin are fully capable of making their own educated decisions, and especially that we do not want the state to mandate vaccines for our children.

Backstory:
CR 19-079 is a Clearing House Rule that went into effect Feb. 1, 2023, to MANDATE the Meningococcal vaccine for Wisconsin 7th graders, and a booster dose in 12th grade - but WE CAN STOP IT!
In 2019, Wisconsin United For Freedom found out that Wisconsin DHS was working on some administrative rule changes at the state level, in which they were trying to get the meningococcal vaccine onto the required schedule for school for Wisconsin children, among some other changes.

We strongly oppose their proposed rules 1, 2, 4, and 5.
Rule 1) Varicella (chicken pox) and meningococcal disease are identified by the department as vaccine-preventable diseases. However, a substantial outbreak of these diseases is not currently defined in ch. DHS 144. The department proposes to amend the definition of a “substantial outbreak” to include Varicella (chicken pox) and meningococcal disease, and to ensure consistency with CDC recommendations.
a. Our stance: Change in the ‘substantial outbreak’ classification to include chicken pox, an illness historically considered mild prior to the introduction of a vaccine. By changing the definition of ‘substantial outbreak,’ unvaccinated children will be punished and excluded from school, even though data collected from Wisconsin DHS has demonstrated that the vaccine fails to protect, and fully vaccinated individuals can still develop chickenpox. Rule 2) In recent years, mumps outbreaks have occurred in highly-vaccinated populations and in high-transmission settings, including elementary, middle, and high schools, colleges, and camps. A substantial outbreak of mumps is currently defined as an incidence of the disease exceeding 2% of the unvaccinated population. In 2012, the CDC revised the Manual for the Surveillance of Vaccine-Preventable Diseases, to define a substantial outbreak of mumps as three or more cases linked by time and place. The department proposes to amend the definition of a “substantial outbreak” of mumps to be consistent with the CDC Manual for the Surveillance of Vaccine-Preventable Diseases.
b. Our stance: Change in the ‘substantial outbreak’ definition of mumps from “an incidence of the disease exceeding 2% of the unvaccinated population” to define ‘substantial outbreak’ as “three or more cases linked by time and place.” By changing the definition of ‘substantial outbreak,’ unvaccinated children will be excused from school even though data collected from DHS clearly shows that unvaccinated individuals are not developing mumps. Vaccine failure related to an ineffective vaccine is responsible for all reported mumps cases in Wisconsin in recent years. This is not unique to Wisconsin. Numerous studies examining mumps outbreaks that have occurred in highly vaccinated populations have experts admitting that both the waning of vaccine-acquired immunity and an ineffective mumps vaccine are to blame.
Rule 4) Neisseria meningitidis is a vaccine-preventable disease and a leading cause of bacterial meningitis and sepsis in the United States. The meningococcal vaccine is recommended by the Wisconsin Chapter of the American Academy of Pediatrics and the Wisconsin Academy of Family Physicians to reduce the incidence of bacterial meningitis and sepsis. Since 2005, the CDC Advisory Committee on Immunization Practices has recommended that the vaccine be administered at the 11-12 year old health care visit, along with other routine vaccinations such as Tdap. The department proposes to add the meningococcal vaccine to the list of vaccines required for students entering the 7th grade. This provision will ease the burden on families, providers, and schools by ensuring that both meningococcal and Tdap vaccines are received at the same visit and the same grade level. The department also proposes a booster dose for students entering 12th grade which is in accordance with ACIP recommendations. This will help to ensure students are fully vaccinated prior to leaving school.
c. Our stance: The meningococcal vaccine does not provide herd immunity, and most American children will asymptomatically develop immunity to meningococcal disease as they progress to adulthood. Meningococcal disease caused by serotypes A, C, W, and Y had already decreased to historical lows prior to the introduction of MenACWY vaccine in 2005. While public health officials report that the vaccine has decreased the rates even further, rates of the disease have decreased in all age groups – including the age groups for which the vaccine is not recommended. The incidence of meningococcal disease in the U.S. is already well below the Healthy People 2020 goal. Further, the vaccine is only 80-85% effective but after 2-5 years, it has been found to be at best only 58% effective. Wisconsin has a high voluntary compliance rate for ages 13-17 - the targeted age group for this rule, and this vaccine will continue to be available to any family desiring it.
Rule 5) Under the current rule, a parent or adult student may report a history of varicella disease as an acceptable exception to varicella vaccination. Recent studies have demonstrated that there is a high incidence of unvaccinated children who report a positive history of varicella that are not immune. The department proposes to allow the exception only when a history of varicella disease has been reported by a health care provider.
d. Our stance - Parents would no longer be able to report their child’s chicken pox illness and would be required to see a healthcare provider to confirm infection. Chicken pox is generally a mild disease not requiring medical attention. Insisting that parents must take their highly contagious child to a doctor puts immunocompromised individuals at risk of contracting the illness and potentially suffering more serious adverse outcomes. Families would take on the financial burden of all chargers involved with visiting the doctor for a diagnosis. There is no provision for a titer test to be used as proof of immunity. This change may impact children who have had the illness in the past.
There was a public hearing, in the Committee on Constitution and Ethics on 3/5/2020. Then there was another committee meeting on 5/5/2020 in the Joint Committee for Review of Administrative Rules. We were successfully able to encourage the JCRAR committee to vote 6-4 in objection to the rules. Because of their vote, we had temporarily halted the implementation of these rules by DHS. The goal was to get a new governor into office who would permanently halt these rules, but that did not happen.
Because we did not get a new governor into office, we now must work through this process again and try and halt these rules from going into effect. As of right now, these rules went into effect Feb. 1, 2023.
With enough of a push, we could urge our Republican legislators on the JCRAR committee to hold a hearing and possibly suspend these rules.

***Senate Bill 336; Relating to: prohibiting discrimination based on vaccination status.
We believe this bill is the best bill to support. It encompasses many areas, and adds changes to the various discrimination laws in Wisconsin.
This bill prohibits discrimination on the basis of vaccination status, which is defined in the bill as whether an individual has received one or more doses of a vaccine. The bill also make changes to various discrimination laws, including all of the following:
1. Current law prohibits discrimination in employment, housing, and the equal enjoyment of a public place of accommodation or amusement on the basis of a person's disability. Current law also requires certain state agencies, authorities, and corporations to include provisions in contracts they execute obliging the contractor to similarly not discriminate against any employee or applicant for employment. The bill adds vaccination status as a prohibited basis for discrimination in these areas.
2. Current law prohibits the University of Wisconsin System, the Technical College System, public elementary and secondary schools, and charter schools from discriminating against a student on the basis of the student's disability. The bill prohibits the same educational institutions from discriminating against a student on the basis of the student's vaccination status. The bill also prohibits the UW System Board of Regents from investing gifts, grants, and bequests in companies that practice discrimination based on vaccination status.
3. Current law prohibits the exclusion of an individual from jury duty on the basis of the individual's physical condition. The bill adds vaccination status as a prohibited basis for exclusion of an individual from jury duty.
4. The bill prohibits discrimination against an otherwise qualified person in the adoption of minor children because of the person's vaccination status.
5. Current law requires the heads of departments and independent agencies in the executive branch of state government to determine whether there is arbitrary discrimination on several bases and to take remedial action if such discrimination is found. The bill requires these heads to also determine if there is discrimination on the basis of vaccination status and take remedial action regarding such discrimination.
6. Current law prohibits discrimination against an employee, prospective employee, patient, or resident of an approved treatment facility providing treatment of alcoholic, drug dependent, mentally ill, or developmentally disabled persons on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
7. Current law prohibits state agency rules from discriminating against a person on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
8. Current law prohibits discrimination on several bases in the provision of vocational rehabilitation or mental health services. The bill adds vaccination status to the prohibited bases of discrimination.
9. The bill prohibits an insurer from discriminating against an individual on the basis of vaccination status and also prohibits motor carriers, automobile insurers, transportation network companies, and real estate brokers and salespersons from discriminating against an individual on the basis of vaccination status.
Senate Bill 383: Relating to: prohibiting proof of vaccination for COVID-19 as a condition of receiving business and government services.
This bill forbids the state, any governmental entity, and any business or legal entity engaged in any enterprise in the state from requiring any person to provide proof that the person has received a vaccine against the SARS-CoV-2 coronavirus, which causes COVID-19, as a condition of receiving any services, transacting any business, accessing any building, or participating in any function.
Senate Bill 337; Relating to: prohibiting businesses from discriminating against customers due to vaccination record.
This bill prohibits any business or legal entity engaged in any enterprise in the state from discriminating against any customer, client, or potential customer or client based on that person's vaccination record.
Senate Bill 342; Relating to: prohibiting discrimination based on whether the person has received a COVID-19 vaccine.
This bill forbids the state and any governmental entity from discriminating against any person based on whether the person has received a vaccine against the SARS-CoV-2 coronavirus, which causes COVID-19, or is able to show proof of having received such a vaccine.

Why the Call to Action?
Back on August 30th, 2021, Wisconsin United for Freedom sent out a ‘Call To Action’ with respect to the UW System. We issued a ‘Call to Action’ because as a state agency, the University of Wisconsin System is required by state law to submit administrative rule changes to the legislature, specifically the Joint Committee for Review of Administrative Rules (JCRAR). On August 3rd, 2021, JCRAR passed a motion requiring the University of Wisconsin System, a State Agency, to submit their COVID-19 policies to the legislature/JCRAR by September 2nd, 2021. However, on August 24th, 2021, UW System President Tommy Thompson stated that he would not be submitting the UW System’s COVID-19 policies to the legislature/JCRAR, in violation of the August 3rd motion, and they have yet to do so.
In our previous ‘Call to Action’, we stated that if the Senate and Assembly leadership did not move forward on pursuing legal action against the UW System regarding this issue, that worse policies were going to be attempted to be implemented in the future, such as vaccine mandates. This is exactly what is taking place now. The UW System is planning to follow federal vaccine mandates for employees.
If the UW System is allowed to continue with this defyingly brazen abuse of power, they could potentially implement more restrictive COVID-19 policies in the future such as:
• COVID-19 vaccine mandates for all students and even campus visitors
• Required submission of personal health records, such as COVID-19 vaccination status
• Implementation of discriminatory policies against individuals who do not wish to publicly disclose their health records or who have chosen not to receive a COVID-19 vaccine
If this taxpayer funded educational system is not held accountable to the Wisconsin constitution, they will continue to boldly push, inch by inch, to see what other unconstitutional restrictions they can get away with. If action is not taken by the legislature, the UW System will push the boundaries even further and could potentially disallow individuals from attending college within the UW System based on whether they are vaccinated or not.
We encourage all freedom fighters in Wisconsin to pick up the phone daily starting October 29th, 2021, through Tuesday, November 2nd, and CALL Speaker Vos and Senate Majority Leader Devin LeMahieu and request that they stand up to the bullies of the UW System and pursue legal action so that the law is followed. 1. Passage of AB309 would ensure that all students are granted an equal opportunity to attend any college that they have been accepted into, and not denied entry based on vaccination status. Subjecting a subset of the population to mandatory masks and/or frequent testing if they wish to decline a vaccine is unjust. Just as they cannot legally be discriminated against based on their race, ethnicity, gender, or religion, they should also expect that they would not be discriminated against based on vaccination status.
2. Wisconsin is at a high risk of losing many skilled workers should businesses begin imposing vaccine mandates. Additionally, many workers may not tolerate indefinite masking, and choose to quit rather than being singled out for declining to receive or show proof of vaccination. We currently have a severe shortage of skilled workers, especially healthcare professionals. Losing more workers will be catastrophic to our economy. While some employers want to mandate vaccines, it remains unknown whether these same employers would cover medical expenses should a vaccine they mandate cause harm. Where there is a risk, there must always be a choice.
3. Forcing people to show proof of vaccination in order to enter a place of business, or receive a service is discrimination. No one should have the right to demand knowledge of our personal healthcare decisions or be permitted to discriminate against you if you choose not to disclose this. All healthy individuals must be permitted to move freely in society. Without AB309, there is no guarantee that you will be permitted access to services should you decline to receive a vaccine or show proof of vaccination.

It’s time to up the pressure Wisconsin! After an absolutely amazing turnout for the Assembly Committee on Constitution and Ethics public hearing on AB309, AB299, AB303, AB316, and AB347, it looks promising that all five bills will be passed by the committee, likely on either June 8th or June 9th . While all of these are good bills and move us in the right direction, AB309 is the most comprehensive and is the only one that would protect all individuals against discrimination based on vaccination status for all vaccines.
But there is no guarantee that all of these bills will move to the floor for the entire Assembly to vote on. This is where we need YOU! Please make this action item a priority, in the name of health freedom in Wisconsin!

All of these bills protect against what is currently the widespread promotion of segregation and discrimination based on vaccination status. Discrimination is a huge topic in our society today and I hope you consider that discrimination against Wisconsinites based on their vaccination status of one, some, or all vaccines, is just as important as discrimination based on race, sexual orientation, or discrimination based on a disability.
Wisconsinites may choose not to get vaccinated against Covid-19, or any other illness, for many reasons, including medical or religious reasons. Some may decline because they may have had a reaction to a previous vaccination, or feel that the risk of the side effects of the vaccine outweigh the risks of getting Covid-19.
The choice to receive any medical procedure should be left up to the individual and that decision should be made without endorsement or coercion from their employer, other businesses, or state agencies. The choice whether or not to vaccinate against one or many diseases should not force individuals to change jobs and/or careers; individuals must be free to work in their chosen field without fear of repercussions based on their vaccination status, especially when the medical decision comes with the risk of side effects including death.

AB309 is an all-encompassing bill that prohibits discrimination based on vaccination status
***AB309 (companion bill SB336) passed committee in June, 2021. It is currently sitting and waiting to be scheduled for a vote on the full Assembly floor. This is the final step on the Assembly side before going to the Governor’s desk. Speaker Vos is instrumental when it comes to which bills are scheduled for a full floor vote. ***
AB309 – This bill prohibits discrimination on the basis of vaccination status, which is defined in the bill as whether an individual has received one or more doses of a vaccine. The bill also makes changes to various discrimination laws, including all of the following:
1. Current law prohibits discrimination in employment, housing, and the equal enjoyment of a public place of accommodation or amusement on the basis of a person's disability. Current law also requires certain state agencies, authorities, and corporations to include provisions in contracts they execute obliging the contractor to similarly not discriminate against any employee or applicant for employment. The bill adds vaccination status as a prohibited basis for discrimination in these areas.
2. Current law prohibits the University of Wisconsin System, the Technical College System, public elementary and secondary schools, and charter schools from discriminating against a student on the basis of the student's disability. The bill prohibits the same educational institutions from discriminating against a student on the basis of the student's vaccination status. The bill also prohibits the UW System Board of Regents from investing gifts, grants, and bequests in companies that practice discrimination based on vaccination status.
3. Current law prohibits the exclusion of an individual from jury duty on the basis of the individual's physical condition. The bill adds vaccination status as a prohibited basis for exclusion of an individual from jury duty.
4. The bill prohibits discrimination against an otherwise qualified person in the adoption of minor children because of the person's vaccination status.
5. Current law requires the heads of departments and independent agencies in the executive branch of state government to determine whether there is arbitrary discrimination on several bases and to take remedial action if such discrimination is found. The bill requires these heads to also determine if there is discrimination on the basis of vaccination status and take remedial action regarding such discrimination.
6. Current law prohibits discrimination against an employee, prospective employee, patient, or resident of an approved treatment facility providing treatment of alcoholic, drug dependent, mentally ill, or developmentally disabled persons on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
7. Current law prohibits state agency rules from discriminating against a person on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
8. Current law prohibits discrimination on several bases in the provision of vocational rehabilitation or mental health services. The bill adds vaccination status to the prohibited bases of discrimination.
9. The bill prohibits an insurer from discriminating against an individual on the basis of vaccination status and also prohibits motor carriers, automobile insurers, transportation network companies, and real estate brokers and salespersons from discriminating against an individual on the basis of vaccination status

I am writing to request that you schedule a public hearing regarding CR 19-079 in the Joint Committee for Review of Administrative Rules.
Though this rule change, which already went into effect Feb. 1, 2023, WI DHS is now mandating the meningococcal vaccine for Wisconsin children entering 7th grade. They are also adding a booster dose for students entering 12th grade. This is unacceptable especially given the last few years we have all had to deal with bureaucratic overreach by our public health agencies at both the state and the federal level. This vaccination remains available to any parent who wishes for their child to receive it. The issue for us here, is that because it’s already available, there is no necessity to add it to the required schedule. Not only is it available, but in 2019, the year the most recent data is reported by the CDC, only 1 case was reported in Wisconsin for the serogroup ACWY of which this vaccine targets.[i]
What cannot be understated, is the fact that it is very clear to us that Wisconsin DHS will continue to do everything in their power to mandate/require as many vaccinations for our children as they possibly can. They were advocating for mandates/requirements at the same time as they were advocating for the removal of one of our exemptions here in Wisconsin back in 2019: our personal exemption (SB262)[ii]. We do not need any more requirements here in Wisconsin. Parents, working hand in hand with their own trusted health care providers, can come to their own decisions on this issue – whatever those decisions are, without the Government heavy handedly imposing yet another mandate/requirement upon them. Parents can already choose to get their child vaccinated with the meningococcal vaccine, and over 80% since 2019 voluntarily chose to do so without a mandate.[iii]
Many parents also do not know that they can use an exemption, and many schools or health care providers do not easily provide that information willingly to parents. We must not allow DHS the ability to have another mandate/requirement notch on their belts. It will never stop.
Regarding rule 1, by changing the definition of ‘substantial outbreak,’ unvaccinated children will be punished and excluded from school, even though data collected from Wisconsin DHS has demonstrated that the vaccine fails to protect, and fully vaccinated individuals can still develop chickenpox. Further, several peer-reviewed studies have shown that the live virus chicken pox vaccine can cause vaccine strain chicken pox infection in others via shedding. This information is also noted in the vaccine package insert published by the vaccine manufacturer.
Regarding rule 2, the substantial outbreak definition change, by changing the definition of ‘substantial outbreak,’ unvaccinated children will be excused from school even though data collected from DHS clearly shows that unvaccinated individuals are not developing mumps. Vaccine failure related to an ineffective vaccine is responsible for all reported mumps cases in Wisconsin in recent years. This is not unique to Wisconsin. Numerous studies examining mumps outbreaks that have occurred in highly vaccinated populations have experts admitting that both the waning of vaccine-acquired immunity and an ineffective mumps vaccine are to blame. We must not allow Wisconsin DHS to exclude healthy children from school.
Another point to make is that that DHS states in their proposal that it would be easier for students to get vaccinated for Tdap and the meningococcal vaccine at the same time. Where is the science that shows co-administering this vaccination with others is safe? We know that the CDC also recommends influenza vaccinations, as well as COVID-19 vaccinations for each age group. Where is the science that shows administering the MenACWY vaccine with other vaccines, such as Tdap (3 separate vaccinations), influenza, or COVID-19, is safe for our Wisconsin children?
At the Response to the State of State address back in 2020, Speaker Vos stated, “We won’t allow anyone to mandate vaccinations on our citizens.” I implore those of you on the JCRAR committee to help stand by those words now 3 years later. You have an opportunity to stand for freedom right now, and we ask that you please do so.
As a Wisconsinite, I am calling on you to uphold our rights as citizens and step in to protect our freedom to make individualized medical decisions for ourselves and our families. Do the right thing and ensure that DHS knows that the people of Wisconsin are fully capable of making their own educated decisions, and especially that we do not want the state to mandate vaccines for our children.

Backstory:
CR 19-079 is a Clearing House Rule that went into effect Feb. 1, 2023, to MANDATE the Meningococcal vaccine for Wisconsin 7th graders, and a booster dose in 12th grade - but WE CAN STOP IT!
In 2019, Wisconsin United For Freedom found out that Wisconsin DHS was working on some administrative rule changes at the state level, in which they were trying to get the meningococcal vaccine onto the required schedule for school for Wisconsin children, among some other changes.

We strongly oppose their proposed rules 1, 2, 4, and 5.
Rule 1) Varicella (chicken pox) and meningococcal disease are identified by the department as vaccine-preventable diseases. However, a substantial outbreak of these diseases is not currently defined in ch. DHS 144. The department proposes to amend the definition of a “substantial outbreak” to include Varicella (chicken pox) and meningococcal disease, and to ensure consistency with CDC recommendations.
a. Our stance: Change in the ‘substantial outbreak’ classification to include chicken pox, an illness historically considered mild prior to the introduction of a vaccine. By changing the definition of ‘substantial outbreak,’ unvaccinated children will be punished and excluded from school, even though data collected from Wisconsin DHS has demonstrated that the vaccine fails to protect, and fully vaccinated individuals can still develop chickenpox. Rule 2) In recent years, mumps outbreaks have occurred in highly-vaccinated populations and in high-transmission settings, including elementary, middle, and high schools, colleges, and camps. A substantial outbreak of mumps is currently defined as an incidence of the disease exceeding 2% of the unvaccinated population. In 2012, the CDC revised the Manual for the Surveillance of Vaccine-Preventable Diseases, to define a substantial outbreak of mumps as three or more cases linked by time and place. The department proposes to amend the definition of a “substantial outbreak” of mumps to be consistent with the CDC Manual for the Surveillance of Vaccine-Preventable Diseases.
b. Our stance: Change in the ‘substantial outbreak’ definition of mumps from “an incidence of the disease exceeding 2% of the unvaccinated population” to define ‘substantial outbreak’ as “three or more cases linked by time and place.” By changing the definition of ‘substantial outbreak,’ unvaccinated children will be excused from school even though data collected from DHS clearly shows that unvaccinated individuals are not developing mumps. Vaccine failure related to an ineffective vaccine is responsible for all reported mumps cases in Wisconsin in recent years. This is not unique to Wisconsin. Numerous studies examining mumps outbreaks that have occurred in highly vaccinated populations have experts admitting that both the waning of vaccine-acquired immunity and an ineffective mumps vaccine are to blame.
Rule 4) Neisseria meningitidis is a vaccine-preventable disease and a leading cause of bacterial meningitis and sepsis in the United States. The meningococcal vaccine is recommended by the Wisconsin Chapter of the American Academy of Pediatrics and the Wisconsin Academy of Family Physicians to reduce the incidence of bacterial meningitis and sepsis. Since 2005, the CDC Advisory Committee on Immunization Practices has recommended that the vaccine be administered at the 11-12 year old health care visit, along with other routine vaccinations such as Tdap. The department proposes to add the meningococcal vaccine to the list of vaccines required for students entering the 7th grade. This provision will ease the burden on families, providers, and schools by ensuring that both meningococcal and Tdap vaccines are received at the same visit and the same grade level. The department also proposes a booster dose for students entering 12th grade which is in accordance with ACIP recommendations. This will help to ensure students are fully vaccinated prior to leaving school.
c. Our stance: The meningococcal vaccine does not provide herd immunity, and most American children will asymptomatically develop immunity to meningococcal disease as they progress to adulthood. Meningococcal disease caused by serotypes A, C, W, and Y had already decreased to historical lows prior to the introduction of MenACWY vaccine in 2005. While public health officials report that the vaccine has decreased the rates even further, rates of the disease have decreased in all age groups – including the age groups for which the vaccine is not recommended. The incidence of meningococcal disease in the U.S. is already well below the Healthy People 2020 goal. Further, the vaccine is only 80-85% effective but after 2-5 years, it has been found to be at best only 58% effective. Wisconsin has a high voluntary compliance rate for ages 13-17 - the targeted age group for this rule, and this vaccine will continue to be available to any family desiring it.
Rule 5) Under the current rule, a parent or adult student may report a history of varicella disease as an acceptable exception to varicella vaccination. Recent studies have demonstrated that there is a high incidence of unvaccinated children who report a positive history of varicella that are not immune. The department proposes to allow the exception only when a history of varicella disease has been reported by a health care provider.
d. Our stance - Parents would no longer be able to report their child’s chicken pox illness and would be required to see a healthcare provider to confirm infection. Chicken pox is generally a mild disease not requiring medical attention. Insisting that parents must take their highly contagious child to a doctor puts immunocompromised individuals at risk of contracting the illness and potentially suffering more serious adverse outcomes. Families would take on the financial burden of all chargers involved with visiting the doctor for a diagnosis. There is no provision for a titer test to be used as proof of immunity. This change may impact children who have had the illness in the past.
There was a public hearing, in the Committee on Constitution and Ethics on 3/5/2020. Then there was another committee meeting on 5/5/2020 in the Joint Committee for Review of Administrative Rules. We were successfully able to encourage the JCRAR committee to vote 6-4 in objection to the rules. Because of their vote, we had temporarily halted the implementation of these rules by DHS. The goal was to get a new governor into office who would permanently halt these rules, but that did not happen.
Because we did not get a new governor into office, we now must work through this process again and try and halt these rules from going into effect. As of right now, these rules went into effect Feb. 1, 2023.
With enough of a push, we could urge our Republican legislators on the JCRAR committee to hold a hearing and possibly suspend these rules.

We believe this bill is the best bill to support. It encompasses many areas, and adds changes to the various discrimination laws in Wisconsin.
This bill prohibits discrimination on the basis of vaccination status, which is defined in the bill as whether an individual has received one or more doses of a vaccine. The bill also make changes to various discrimination laws, including all of the following:
1. Current law prohibits discrimination in employment, housing, and the equal enjoyment of a public place of accommodation or amusement on the basis of a person's disability. Current law also requires certain state agencies, authorities, and corporations to include provisions in contracts they execute obliging the contractor to similarly not discriminate against any employee or applicant for employment. The bill adds vaccination status as a prohibited basis for discrimination in these areas.
2. Current law prohibits the University of Wisconsin System, the Technical College System, public elementary and secondary schools, and charter schools from discriminating against a student on the basis of the student's disability. The bill prohibits the same educational institutions from discriminating against a student on the basis of the student's vaccination status. The bill also prohibits the UW System Board of Regents from investing gifts, grants, and bequests in companies that practice discrimination based on vaccination status.
3. Current law prohibits the exclusion of an individual from jury duty on the basis of the individual's physical condition. The bill adds vaccination status as a prohibited basis for exclusion of an individual from jury duty.
4. The bill prohibits discrimination against an otherwise qualified person in the adoption of minor children because of the person's vaccination status.
5. Current law requires the heads of departments and independent agencies in the executive branch of state government to determine whether there is arbitrary discrimination on several bases and to take remedial action if such discrimination is found. The bill requires these heads to also determine if there is discrimination on the basis of vaccination status and take remedial action regarding such discrimination.
6. Current law prohibits discrimination against an employee, prospective employee, patient, or resident of an approved treatment facility providing treatment of alcoholic, drug dependent, mentally ill, or developmentally disabled persons on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
7. Current law prohibits state agency rules from discriminating against a person on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
8. Current law prohibits discrimination on several bases in the provision of vocational rehabilitation or mental health services. The bill adds vaccination status to the prohibited bases of discrimination.
9. The bill prohibits an insurer from discriminating against an individual on the basis of vaccination status and also prohibits motor carriers, automobile insurers, transportation network companies, and real estate brokers and salespersons from discriminating against an individual on the basis of vaccination status.
Senate Bill 383: Relating to: prohibiting proof of vaccination for COVID-19 as a condition of receiving business and government services.
This bill forbids the state, any governmental entity, and any business or legal entity engaged in any enterprise in the state from requiring any person to provide proof that the person has received a vaccine against the SARS-CoV-2 coronavirus, which causes COVID-19, as a condition of receiving any services, transacting any business, accessing any building, or participating in any function.
Senate Bill 337; Relating to: prohibiting businesses from discriminating against customers due to vaccination record.
This bill prohibits any business or legal entity engaged in any enterprise in the state from discriminating against any customer, client, or potential customer or client based on that person's vaccination record.
Senate Bill 342; Relating to: prohibiting discrimination based on whether the person has received a COVID-19 vaccine.
This bill forbids the state and any governmental entity from discriminating against any person based on whether the person has received a vaccine against the SARS-CoV-2 coronavirus, which causes COVID-19, or is able to show proof of having received such a vaccine.

Why the Call to Action?
Back on August 30th, 2021, Wisconsin United for Freedom sent out a ‘Call To Action’ with respect to the UW System. We issued a ‘Call to Action’ because as a state agency, the University of Wisconsin System is required by state law to submit administrative rule changes to the legislature, specifically the Joint Committee for Review of Administrative Rules (JCRAR). On August 3rd, 2021, JCRAR passed a motion requiring the University of Wisconsin System, a State Agency, to submit their COVID-19 policies to the legislature/JCRAR by September 2nd, 2021. However, on August 24th, 2021, UW System President Tommy Thompson stated that he would not be submitting the UW System’s COVID-19 policies to the legislature/JCRAR, in violation of the August 3rd motion, and they have yet to do so.
In our previous ‘Call to Action’, we stated that if the Senate and Assembly leadership did not move forward on pursuing legal action against the UW System regarding this issue, that worse policies were going to be attempted to be implemented in the future, such as vaccine mandates. This is exactly what is taking place now. The UW System is planning to follow federal vaccine mandates for employees.
If the UW System is allowed to continue with this defyingly brazen abuse of power, they could potentially implement more restrictive COVID-19 policies in the future such as:
• COVID-19 vaccine mandates for all students and even campus visitors
• Required submission of personal health records, such as COVID-19 vaccination status
• Implementation of discriminatory policies against individuals who do not wish to publicly disclose their health records or who have chosen not to receive a COVID-19 vaccine
If this taxpayer funded educational system is not held accountable to the Wisconsin constitution, they will continue to boldly push, inch by inch, to see what other unconstitutional restrictions they can get away with. If action is not taken by the legislature, the UW System will push the boundaries even further and could potentially disallow individuals from attending college within the UW System based on whether they are vaccinated or not.
We encourage all freedom fighters in Wisconsin to pick up the phone daily starting October 29th, 2021, through Tuesday, November 2nd, and CALL Speaker Vos and Senate Majority Leader Devin LeMahieu and request that they stand up to the bullies of the UW System and pursue legal action so that the law is followed. Our children’s educational future is at stake, and we encourage all groups who wish to stand up to the top-down Biden Administrations authoritarian vaccine mandates and drastic change in our cultural values to push back against this issue with us in solidarity.

1. Passage of AB309 would ensure that all students are granted an equal opportunity to attend any college that they have been accepted into, and not denied entry based on vaccination status. Subjecting a subset of the population to mandatory masks and/or frequent testing if they wish to decline a vaccine is unjust. Just as they cannot legally be discriminated against based on their race, ethnicity, gender, or religion, they should also expect that they would not be discriminated against based on vaccination status.
2. Wisconsin is at a high risk of losing many skilled workers should businesses begin imposing vaccine mandates. Additionally, many workers may not tolerate indefinite masking, and choose to quit rather than being singled out for declining to receive or show proof of vaccination. We currently have a severe shortage of skilled workers, especially healthcare professionals. Losing more workers will be catastrophic to our economy. While some employers want to mandate vaccines, it remains unknown whether these same employers would cover medical expenses should a vaccine they mandate cause harm. Where there is a risk, there must always be a choice.
3. Forcing people to show proof of vaccination in order to enter a place of business, or receive a service is discrimination. No one should have the right to demand knowledge of our personal healthcare decisions or be permitted to discriminate against you if you choose not to disclose this. All healthy individuals must be permitted to move freely in society. Without AB309, there is no guarantee that you will be permitted access to services should you decline to receive a vaccine or show proof of vaccination.

It’s time to up the pressure Wisconsin! After an absolutely amazing turnout for the Assembly Committee on Constitution and Ethics public hearing on AB309, AB299, AB303, AB316, and AB347, it looks promising that all five bills will be passed by the committee, likely on either June 8th or June 9th . While all of these are good bills and move us in the right direction, AB309 is the most comprehensive and is the only one that would protect all individuals against discrimination based on vaccination status for all vaccines.
But there is no guarantee that all of these bills will move to the floor for the entire Assembly to vote on. This is where we need YOU! Please make this action item a priority, in the name of health freedom in Wisconsin!

All of these bills protect against what is currently the widespread promotion of segregation and discrimination based on vaccination status. Discrimination is a huge topic in our society today and I hope you consider that discrimination against Wisconsinites based on their vaccination status of one, some, or all vaccines, is just as important as discrimination based on race, sexual orientation, or discrimination based on a disability.
Wisconsinites may choose not to get vaccinated against Covid-19, or any other illness, for many reasons, including medical or religious reasons. Some may decline because they may have had a reaction to a previous vaccination, or feel that the risk of the side effects of the vaccine outweigh the risks of getting Covid-19.
The choice to receive any medical procedure should be left up to the individual and that decision should be made without endorsement or coercion from their employer, other businesses, or state agencies. The choice whether or not to vaccinate against one or many diseases should not force individuals to change jobs and/or careers; individuals must be free to work in their chosen field without fear of repercussions based on their vaccination status, especially when the medical decision comes with the risk of side effects including death.
These bills support freedom, choice, and the Constitution, and we respectfully encourage you to vote YES on these bills.

State of Wisconsin – AB23 & AB24 were passed by BOTH the Assembly and Senate. Governor Evers vetoed these bills on 4/23/21.
Tuesday, May 11th: The Assembly will vote to override Governor Tony Evers’ veto of AB 23, which prohibits the Department of Health Services and local health officers from requiring individuals to receive a vaccine against the SARS-CoV-2 coronavirus and AB 24, which prohibits local health officers from closing or forbidding gatherings in places of worship to control outbreaks and epidemics of the 2019 novel coronavirus.

AB309 is an all-encompassing bill that prohibits discrimination based on vaccination status
***AB309 (companion bill SB336) passed committee in June, 2021. It is currently sitting and waiting to be scheduled for a vote on the full Assembly floor. This is the final step on the Assembly side before going to the Governor’s desk. Speaker Vos is instrumental when it comes to which bills are scheduled for a full floor vote. ***
AB309 – This bill prohibits discrimination on the basis of vaccination status, which is defined in the bill as whether an individual has received one or more doses of a vaccine. The bill also makes changes to various discrimination laws, including all of the following:
1. Current law prohibits discrimination in employment, housing, and the equal enjoyment of a public place of accommodation or amusement on the basis of a person's disability. Current law also requires certain state agencies, authorities, and corporations to include provisions in contracts they execute obliging the contractor to similarly not discriminate against any employee or applicant for employment. The bill adds vaccination status as a prohibited basis for discrimination in these areas.
2. Current law prohibits the University of Wisconsin System, the Technical College System, public elementary and secondary schools, and charter schools from discriminating against a student on the basis of the student's disability. The bill prohibits the same educational institutions from discriminating against a student on the basis of the student's vaccination status. The bill also prohibits the UW System Board of Regents from investing gifts, grants, and bequests in companies that practice discrimination based on vaccination status.
3. Current law prohibits the exclusion of an individual from jury duty on the basis of the individual's physical condition. The bill adds vaccination status as a prohibited basis for exclusion of an individual from jury duty.
4. The bill prohibits discrimination against an otherwise qualified person in the adoption of minor children because of the person's vaccination status.
5. Current law requires the heads of departments and independent agencies in the executive branch of state government to determine whether there is arbitrary discrimination on several bases and to take remedial action if such discrimination is found. The bill requires these heads to also determine if there is discrimination on the basis of vaccination status and take remedial action regarding such discrimination.
6. Current law prohibits discrimination against an employee, prospective employee, patient, or resident of an approved treatment facility providing treatment of alcoholic, drug dependent, mentally ill, or developmentally disabled persons on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
7. Current law prohibits state agency rules from discriminating against a person on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
8. Current law prohibits discrimination on several bases in the provision of vocational rehabilitation or mental health services. The bill adds vaccination status to the prohibited bases of discrimination.
9. The bill prohibits an insurer from discriminating against an individual on the basis of vaccination status and also prohibits motor carriers, automobile insurers, transportation network companies, and real estate brokers and salespersons from discriminating against an individual on the basis of vaccination status

Dear Senator/Representative-
I am writing to request that you schedule a public hearing regarding CR 19-079 in the Joint Committee for Review of Administrative Rules.
Though this rule change, which already went into effect Feb. 1, 2023, WI DHS is now mandating the meningococcal vaccine for Wisconsin children entering 7th grade. They are also adding a booster dose for students entering 12th grade. This is unacceptable especially given the last few years we have all had to deal with bureaucratic overreach by our public health agencies at both the state and the federal level. This vaccination remains available to any parent who wishes for their child to receive it. The issue for us here, is that because it’s already available, there is no necessity to add it to the required schedule. Not only is it available, but in 2019, the year the most recent data is reported by the CDC, only 1 case was reported in Wisconsin for the serogroup ACWY of which this vaccine targets.[i]
What cannot be understated, is the fact that it is very clear to us that Wisconsin DHS will continue to do everything in their power to mandate/require as many vaccinations for our children as they possibly can. They were advocating for mandates/requirements at the same time as they were advocating for the removal of one of our exemptions here in Wisconsin back in 2019: our personal exemption (SB262)[ii]. We do not need any more requirements here in Wisconsin. Parents, working hand in hand with their own trusted health care providers, can come to their own decisions on this issue – whatever those decisions are, without the Government heavy handedly imposing yet another mandate/requirement upon them. Parents can already choose to get their child vaccinated with the meningococcal vaccine, and over 80% since 2019 voluntarily chose to do so without a mandate.[iii]
Many parents also do not know that they can use an exemption, and many schools or health care providers do not easily provide that information willingly to parents. We must not allow DHS the ability to have another mandate/requirement notch on their belts. It will never stop.
Regarding rule 1, by changing the definition of ‘substantial outbreak,’ unvaccinated children will be punished and excluded from school, even though data collected from Wisconsin DHS has demonstrated that the vaccine fails to protect, and fully vaccinated individuals can still develop chickenpox. Further, several peer-reviewed studies have shown that the live virus chicken pox vaccine can cause vaccine strain chicken pox infection in others via shedding. This information is also noted in the vaccine package insert published by the vaccine manufacturer.
Regarding rule 2, the substantial outbreak definition change, by changing the definition of ‘substantial outbreak,’ unvaccinated children will be excused from school even though data collected from DHS clearly shows that unvaccinated individuals are not developing mumps. Vaccine failure related to an ineffective vaccine is responsible for all reported mumps cases in Wisconsin in recent years. This is not unique to Wisconsin. Numerous studies examining mumps outbreaks that have occurred in highly vaccinated populations have experts admitting that both the waning of vaccine-acquired immunity and an ineffective mumps vaccine are to blame. We must not allow Wisconsin DHS to exclude healthy children from school.
Another point to make is that that DHS states in their proposal that it would be easier for students to get vaccinated for Tdap and the meningococcal vaccine at the same time. Where is the science that shows co-administering this vaccination with others is safe? We know that the CDC also recommends influenza vaccinations, as well as COVID-19 vaccinations for each age group. Where is the science that shows administering the MenACWY vaccine with other vaccines, such as Tdap (3 separate vaccinations), influenza, or COVID-19, is safe for our Wisconsin children?
At the Response to the State of State address back in 2020, Speaker Vos stated, “We won’t allow anyone to mandate vaccinations on our citizens.” I implore those of you on the JCRAR committee to help stand by those words now 3 years later. You have an opportunity to stand for freedom right now, and we ask that you please do so.
As a Wisconsinite, I am calling on you to uphold our rights as citizens and step in to protect our freedom to make individualized medical decisions for ourselves and our families. Do the right thing and ensure that DHS knows that the people of Wisconsin are fully capable of making their own educated decisions, and especially that we do not want the state to mandate vaccines for our children.

Backstory:
CR 19-079 is a Clearing House Rule that went into effect Feb. 1, 2023, to MANDATE the Meningococcal vaccine for Wisconsin 7th graders, and a booster dose in 12th grade - but WE CAN STOP IT!
In 2019, Wisconsin United For Freedom found out that Wisconsin DHS was working on some administrative rule changes at the state level, in which they were trying to get the meningococcal vaccine onto the required schedule for school for Wisconsin children, among some other changes.

We strongly oppose their proposed rules 1, 2, 4, and 5.
Rule 1) Varicella (chicken pox) and meningococcal disease are identified by the department as vaccine-preventable diseases. However, a substantial outbreak of these diseases is not currently defined in ch. DHS 144. The department proposes to amend the definition of a “substantial outbreak” to include Varicella (chicken pox) and meningococcal disease, and to ensure consistency with CDC recommendations.
a. Our stance: Change in the ‘substantial outbreak’ classification to include chicken pox, an illness historically considered mild prior to the introduction of a vaccine. By changing the definition of ‘substantial outbreak,’ unvaccinated children will be punished and excluded from school, even though data collected from Wisconsin DHS has demonstrated that the vaccine fails to protect, and fully vaccinated individuals can still develop chickenpox. Rule 2) In recent years, mumps outbreaks have occurred in highly-vaccinated populations and in high-transmission settings, including elementary, middle, and high schools, colleges, and camps. In 2012, the CDC revised the Manual for the Surveillance of Vaccine-Preventable Diseases, to define a substantial outbreak of mumps as three or more cases linked by time and place. The department proposes to amend the definition of a “substantial outbreak” of mumps to be consistent with the CDC Manual for the Surveillance of Vaccine-Preventable Diseases.
b. Vaccine failure related to an ineffective vaccine is responsible for all reported mumps cases in Wisconsin in recent years. This is not unique to Wisconsin. Numerous studies examining mumps outbreaks that have occurred in highly vaccinated populations have experts admitting that both the waning of vaccine-acquired immunity and an ineffective mumps vaccine are to blame.
Rule 4) Neisseria meningitidis is a vaccine-preventable disease and a leading cause of bacterial meningitis and sepsis in the United States. The meningococcal vaccine is recommended by the Wisconsin Chapter of the American Academy of Pediatrics and the Wisconsin Academy of Family Physicians to reduce the incidence of bacterial meningitis and sepsis. Since 2005, the CDC Advisory Committee on Immunization Practices has recommended that the vaccine be administered at the 11-12 year old health care visit, along with other routine vaccinations such as Tdap. The department proposes to add the meningococcal vaccine to the list of vaccines required for students entering the 7th grade. This provision will ease the burden on families, providers, and schools by ensuring that both meningococcal and Tdap vaccines are received at the same visit and the same grade level. The department also proposes a booster dose for students entering 12th grade which is in accordance with ACIP recommendations. This will help to ensure students are fully vaccinated prior to leaving school.
c. Our stance: The meningococcal vaccine does not provide herd immunity, and most American children will asymptomatically develop immunity to meningococcal disease as they progress to adulthood. Meningococcal disease caused by serotypes A, C, W, and Y had already decreased to historical lows prior to the introduction of MenACWY vaccine in 2005. While public health officials report that the vaccine has decreased the rates even further, rates of the disease have decreased in all age groups – including the age groups for which the vaccine is not recommended. The incidence of meningococcal disease in the U.S. is already well below the Healthy People 2020 goal. Further, the vaccine is only 80-85% effective but after 2-5 years, it has been found to be at best only 58% effective. Wisconsin has a high voluntary compliance rate for ages 13-17 - the targeted age group for this rule, and this vaccine will continue to be available to any family desiring it.
Rule 5) Under the current rule, a parent or adult student may report a history of varicella disease as an acceptable exception to varicella vaccination. Recent studies have demonstrated that there is a high incidence of unvaccinated children who report a positive history of varicella that are not immune. The department proposes to allow the exception only when a history of varicella disease has been reported by a health care provider.
d. Our stance - Parents would no longer be able to report their child’s chicken pox illness and would be required to see a healthcare provider to confirm infection. Chicken pox is generally a mild disease not requiring medical attention. Insisting that parents must take their highly contagious child to a doctor puts immunocompromised individuals at risk of contracting the illness and potentially suffering more serious adverse outcomes. Families would take on the financial burden of all chargers involved with visiting the doctor for a diagnosis. There is no provision for a titer test to be used as proof of immunity. This change may impact children who have had the illness in the past.
There was a public hearing, in the Committee on Constitution and Ethics on 3/5/2020. Then there was another committee meeting on 5/5/2020 in the Joint Committee for Review of Administrative Rules. We were successfully able to encourage the JCRAR committee to vote 6-4 in objection to the rules. Because of their vote, we had temporarily halted the implementation of these rules by DHS. The goal was to get a new governor into office who would permanently halt these rules, but that did not happen.
Because we did not get a new governor into office, we now must work through this process again and try and halt these rules from going into effect. As of right now, these rules went into effect Feb. 1, 2023.
With enough of a push, we could urge our Republican legislators on the JCRAR committee to hold a hearing and possibly suspend these rules.

Current law prohibits the University of Wisconsin System, the Technical College System, public elementary and secondary schools, and charter schools from discriminating against a student on the basis of the student's disability. The bill prohibits the same educational institutions from discriminating against a student on the basis of the student's vaccination status. The bill also prohibits the UW System Board of Regents from investing gifts, grants, and bequests in companies that practice discrimination based on vaccination status.
3. Current law prohibits the exclusion of an individual from jury duty on the basis of the individual's physical condition. The bill adds vaccination status as a prohibited basis for exclusion of an individual from jury duty.
4. The bill prohibits discrimination against an otherwise qualified person in the adoption of minor children because of the person's vaccination status.
5. Current law requires the heads of departments and independent agencies in the executive branch of state government to determine whether there is arbitrary discrimination on several bases and to take remedial action if such discrimination is found. The bill requires these heads to also determine if there is discrimination on the basis of vaccination status and take remedial action regarding such discrimination.
6. Current law prohibits discrimination against an employee, prospective employee, patient, or resident of an approved treatment facility providing treatment of alcoholic, drug dependent, mentally ill, or developmentally disabled persons on several bases. The bill adds vaccination status as a prohibited basis of discrimination.
7. Current law prohibits state agency rules from discriminating against a person on several bases. The bill adds vaccination status as a prohibited basis of discrimination.

This bill forbids the state, any governmental entity, and any business or legal entity engaged in any enterprise in the state from requiring any person to provide proof that the person has received a vaccine against the SARS-CoV-2 coronavirus, which causes COVID-19, as a condition of receiving any services, transacting any business, accessing any building, or participating in any function.
Senate Bill 337; Relating to: prohibiting businesses from discriminating against customers due to vaccination record.
This bill prohibits any business or legal entity engaged in any enterprise in the state from discriminating against any customer, client, or potential customer or client based on that person's vaccination record.
Senate Bill 342; Relating to: prohibiting discrimination based on whether the person has received a COVID-19 vaccine.
This bill forbids the state and any governmental entity from discriminating against any person based on whether the person has received a vaccine against the SARS-CoV-2 coronavirus, which causes COVID-19, or is able to show proof of having received such a vaccine.

Why the Call to Action?
Back on August 30th, 2021, Wisconsin United for Freedom sent out a ‘Call To Action’ with respect to the UW System. We issued a ‘Call to Action’ because as a state agency, the University of Wisconsin System is required by state law to submit administrative rule changes to the legislature, specifically the Joint Committee for Review of Administrative Rules (JCRAR). On August 3rd, 2021, JCRAR passed a motion requiring the University of Wisconsin System, a State Agency, to submit their COVID-19 policies to the legislature/JCRAR by September 2nd, 2021. However, on August 24th, 2021, UW System President Tommy Thompson stated that he would not be submitting the UW System’s COVID-19 policies to the legislature/JCRAR, in violation of the August 3rd motion, and they have yet to do so.
In our previous ‘Call to Action’, we stated that if the Senate and Assembly leadership did not move forward on pursuing legal action against the UW System regarding this issue, that worse policies were going to be attempted to be implemented in the future, such as vaccine mandates. This is exactly what is taking place now. The UW System is planning to follow federal vaccine mandates for employees.
If the UW System is allowed to continue with this defyingly brazen abuse of power, they could potentially implement more restrictive COVID-19 policies in the future such as:
• COVID-19 vaccine mandates for all students and even campus visitors
• Required submission of personal health records, such as COVID-19 vaccination status
• Implementation of discriminatory policies against individuals who do not wish to publicly disclose their health records or who have chosen not to receive a COVID-19 vaccine
If this taxpayer funded educational system is not held accountable to the Wisconsin constitution, they will continue to boldly push, inch by inch, to see what other unconstitutional restrictions they can get away with. If action is not taken by the legislature, the UW System will push the boundaries even further and could potentially disallow individuals from attending college within the UW System based on whether they are vaccinated or not.
We encourage all freedom fighters in Wisconsin to pick up the phone daily starting October 29th, 2021, through Tuesday, November 2nd, and CALL Speaker Vos and Senate Majority Leader Devin LeMahieu and request that they stand up to the bullies of the UW System and pursue legal action so that the law is followed. Our children’s educational future is at stake, and we encourage all groups who wish to stand up to the top-down Biden Administrations authoritarian vaccine mandates and drastic change in our cultural values to push back against this issue with us in solidarity.

Whether you talk to a person or leave a message, PLEASE remain respectful.
1. Passage of AB309 would ensure that all students are granted an equal opportunity to attend any college that they have been accepted into, and not denied entry based on vaccination status. Subjecting a subset of the population to mandatory masks and/or frequent testing if they wish to decline a vaccine is unjust. Just as they cannot legally be discriminated against based on their race, ethnicity, gender, or religion, they should also expect that they would not be discriminated against based on vaccination status.
2. Wisconsin is at a high risk of losing many skilled workers should businesses begin imposing vaccine mandates. Additionally, many workers may not tolerate indefinite masking, and choose to quit rather than being singled out for declining to receive or show proof of vaccination. We currently have a severe shortage of skilled workers, especially healthcare professionals. Losing more workers will be catastrophic to our economy. While some employers want to mandate vaccines, it remains unknown whether these same employers would cover medical expenses should a vaccine they mandate cause harm. Where there is a risk, there must always be a choice.
3. Forcing people to show proof of vaccination in order to enter a place of business, or receive a service is discrimination. No one should have the right to demand knowledge of our personal healthcare decisions or be permitted to discriminate against you if you choose not to disclose this. All healthy individuals must be permitted to move freely in society. Without AB309, there is no guarantee that you will be permitted access to services should you decline to receive a vaccine or show proof of vaccination.

Please ALSO call your personal Assembly Representative on TUESDAY, JUNE 8TH if they are not one of the individuals mentioned above and tell them to ask the above individuals to move AB309 forward. It’s time to up the pressure Wisconsin! After an absolutely amazing turnout for the Assembly Committee on Constitution and Ethics public hearing on AB309, AB299, AB303, AB316, and AB347, it looks promising that all five bills will be passed by the committee, likely on either June 8th or June 9th . While all of these are good bills and move us in the right direction, AB309 is the most comprehensive and is the only one that would protect all individuals against discrimination based on vaccination status for all vaccines.
But there is no guarantee that all of these bills will move to the floor for the entire Assembly to vote on. This is where we need YOU! Please make this action item a priority, in the name of health freedom in Wisconsin!

Dear Representative,
I am writing to share my support for AB299, AB303, AB309, AB316, and AB347.
All of these bills protect against what is currently the widespread promotion of segregation and discrimination based on vaccination status. Discrimination is a huge topic in our society today and I hope you consider that discrimination against Wisconsinites based on their vaccination status of one, some, or all vaccines, is just as important as discrimination based on race, sexual orientation, or discrimination based on a disability.
Wisconsinites may choose not to get vaccinated against Covid-19, or any other illness, for many reasons, including medical or religious reasons. Some may decline because they may have had a reaction to a previous vaccination, or feel that the risk of the side effects of the vaccine outweigh the risks of getting Covid-19.
The choice to receive any medical procedure should be left up to the individual and that decision should be made without endorsement or coercion from their employer, other businesses, or state agencies. The choice whether or not to vaccinate against one or many diseases should not force individuals to change jobs and/or careers; individuals must be free to work in their chosen field without fear of repercussions based on their vaccination status, especially when the medical decision comes with the risk of side effects including death.
These bills support freedom, choice, and the Constitution, and we respectfully encourage you to vote YES on these bills.

State of Wisconsin - AB 23 & AB 24: Call/email your OWN Representative
ASSEMBLY VETO OVERRIDE
Deadline: Tuesday May 11th 2021, 1:00pm
State of Wisconsin – AB23 & AB24 were passed by BOTH the Assembly and Senate. Governor Evers vetoed these bills on 4/23/21.
Tuesday, May 11th: The Assembly will vote to override Governor Tony Evers’ veto of AB 23, which prohibits the Department of Health Services and local health officers from requiring individuals to receive a vaccine against the SARS-CoV-2 coronavirus and AB 24, which prohibits local health officers from closing or forbidding gatherings in places of worship to control outbreaks and epidemics of the 2019 novel coronavirus.
AB23 Relating to: prohibiting certain government officials from mandating vaccination against the coronavirus.
AB24 Relating to: closure of and forbidding gatherings in places of worship.
Both of these bills support freedom and choice. Wisconsin United For Freedom stands for both freedom and choice and these bills are a shining example of the type of legislation that we need in our state.
